Phonetastic provides an AI-powered receptionist service that answers phone calls, books appointments, captures leads, and delivers call summaries on your behalf. The Service may include web-based dashboards, integrations, and related tools.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Service.
• You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Engage in fraudulent, deceptive, or misleading activities.

5. Call Handling and AI Limitations

You acknowledge that the Service is not a substitute for human judgment in critical or emergency situations. We recommend reviewing call summaries and maintaining human oversight for important communications.

6. Payments and Billing

• Fees for the Service are outlined on our website or in your subscription agreement.
• Payments are billed in advance on a recurring basis unless otherwise specified.
• You are responsible for all applicable taxes associated with your use of the Service.
• Refunds are handled on a case-by-case basis at our discretion.

7. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Phonetastic and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law, Phonetastic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability shall not exceed the amount paid by you to Phonetastic in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may cancel your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
